MBC [100 Minute Debate]

Broadcast: Tonight (8th) at 11:20 PM

The Blue House has rejected Chief Justice Cho Hee-dae's nomination of Supreme Court Justice candidate Son Bong-gi and requested a re-nomination. This is the first time since the 1987 constitutional system that a President has returned a Supreme Court Justice candidate.

The Blue House stated the reason for the re-nomination, saying, "A unilateral nomination without sufficient consultation is a nomination that lacks procedural completeness," and "The right to nominate is an authority that supports the appointment power of the President, who holds elected power."

In response, a fierce debate over constitutional interpretation is intensifying within the legal community regarding the Blue House's request for re-nomination. Views are sharply divided between those who see the appointment power and the nomination power as equal authorities under the separation of powers, and those who believe the appointment power should effectively be viewed as a superior authority to the nomination power.

In particular, the impact is significant as 22 out of the 26 Supreme Court Justices, who will eventually increase according to the Supreme Court Justice Expansion Act, are scheduled to be appointed during the current administration's term.

The MBC [100 Minute Debate] broadcasting tonight (8th) at 11:20 PM will focus on the issues of Supreme Court Justice selection triggered by the request for re-nomination and the long-standing conflict between the Blue House and the judiciary under the theme .

The broadcast will feature National Assembly member Park Ju-min of the Democratic Party of Korea, former National Power Party member Kim Young-woo, Professor Emeritus Han Sang-hee of Konkuk University Law School, and Professor Emeritus Lee Heon-hwan of Ajou University Law School. They are scheduled to engage in in-depth discussions regarding the interpretation of the powers of the President and the Chief Justice as prescribed by the Constitution, along with alternatives for ensuring that democratic principles are fully implemented in the process of selecting Supreme Court Justices.
